Caution

As a result of its investigation of a formal complaint, the Inquiries, Complaints and Reports Committee decided to caution Dr. Ragnitz as follows:

•   It is inappropriate to dismiss a patient from your practice due to non-payment of bills. There are other avenues by which you can seek to collect payment, but you cannot abandon a patient mid-treatment.
•   In the event that a dentist-patient relationship deteriorates and you wish to dismiss a patient from your practice, you should inform the patient in an appropriate fashion, preferably in writing. A well-constructed letter will contain the following information:
      -  The reason for dismissal.
      -  An outline of any outstanding treatment needs.
      -  Information to assist the patient in locating a new dentist (i.e. provide the contact number for the Ontario Dental Association).
      -  Advise the patient that you will forward copies of records to the new dentist.
      -  Advise the patient that s/he will be seen in a true emergency, until a new dentist can be obtained
      -  Provide the telephone number of the dental emergency service, if one is available.

Caution

As a result of its investigation of a formal complaint, the Inquiries, Complaints and Reports Committee decided to caution Dr. Ragnitz as follows:

•    As a member of a regulated profession, it is Dr. Ragnitz’s professional obligation to cooperate with an investigation of his governing body. In this case, the College was forced to make many attempts to ask Dr. Ragnitz to comply with its request for records over several months before Dr. Ragnitz even responded. He then provided the College with misleading information and gave assurances to the College in relation to sending the records requested that he did not follow through with. The College ultimately had to obtain the records requested on its own as Dr. Ragnitz did not submit them.

•    Dr. Ragnitz must comply with requests for patient records whether from a patient, an authorized agent acting on behalf of a patient or from the College in a timely and professional manner. The patient in this case only filed a complaint with the College after attempting to obtain his records from Dr. Ragnitz by way of multiple requests and having received no communication at all for about nine months. Dr. Ragnitz also did not respond to the request for records when it was made by legal counsel on behalf of the patient.
