Caution

As a result of its investigation of a formal complaint, the Inquiries, Complaints and Reports Committee decided to caution Dr. Greenacre as follows:

•    Given the irregular radiolucency around the roots of tooth 47 in a child patient, which was readily apparent on the pre-operative radiograph, the member should have:
     - clearly documented his clinical and radiographic findings about the irregular radiolucency.
     - recognized the need to offer the patient the option of a referral to a specialist prior to embarking on any treatment in this area. 
     - submitted a tissue sample for biopsy if the patient declined the referral and chose to proceed with treatment in his office.
     - developed a follow-up plan which would then be clearly communicated to the patient.

•    It is his professional, ethical and legal responsibility to ensure that he maintains a complete chart which documents all aspects of each patient’s dental care. Such documentation must include a record of his clinical observations and radiographic findings, his diagnosis, the treatment plan and alternatives, as well as the treatment rendered.

•    His clinical records must include documentation of his discussions with patients in order to obtain informed consent to treatment. Such discussions would include information regarding the diagnosis, the nature and purpose of the proposed treatment along with the risks and benefits of such treatment, the treatment alternatives available along with the associated risks and benefits, the likely consequences of not having the treatment, and the cost of each treatment option. Although either verbal or written consent are both legally acceptable, it is advisable to confirm verbal consent in writing where risks are significant. Regardless of whether the patient consents in writing or orally, the dentist should keep a detailed record of the nature of the conversation, the information provided, and the patient’s decision.

•    As a general dentist treating a patient who is referred to him for orthodontic treatment only, he is obligated to ensure that the patient is informed that he is a general dentist and not a specialist.

•    It is clear to the panel through a review of the member’s prior decisions that the member has failed to apply the teachings from previous remedial action with respect to his recordkeeping and informed consent protocols.  The panel cautions the member that it is essential that he diligently and consistently apply to his practice the lessons learned from the further remedial education he will complete as a result of this matter.

As a result of its investigation of a complaint, the Inquires, Complaints and Reports Committee decided to caution Dr. Paul Greenacre as follows:

•His recordkeeping standards must become consistent. The panel is troubled that that despite previous remediation, the member does appear to consistently implement the lessons learned and integrate the knowledge gained in his practice. 

•The member should use this opportunity to demonstrate his governability with respect to his recordkeeping in order to avoid further regulatory action.
