INTERIM ORDER: a. Dr. Haydarian must inform the Registrar in writing at least 48 hours in advance of his intention to practise dentistry at any location other than his current place of business at 707 Mount Pleasant Road, Toronto; b. Dr. Haydarian shall not treat any patients under 18 years of age in any circumstance, including emergency treatment; c. Dr. Haydarian shall not practise dentistry unless in the presence of one or more practice monitor(s) who have been retained at his expense and who meet the requirements in subparagraph (k), and who are approved by the Royal College of Dental Surgeons of Ontario (the “College”); d. Dr. Haydarian shall not interact with patients, whether in person or by electronic or any other means, unless in the presence of one or more practice monitor(s) who have been retained at his expense, who meet the requirements in subparagraph (k), who are approved by the College, and who are fluent in the language he is using to communicate with the patient. The practice monitor shall continuously observe, without obstruction, any and all interactions with patients; e. if the practice monitor is not a dentist licensed to practise in Ontario, Dr. Haydarian shall also retain a dentist licensed to practice in Ontario, and approved by the College, to act as a supervisor of the practice monitor and Dr. Haydarian’s office as a whole, and who shall attend the office, at minimum, once a week, on days during which Dr. Haydarian is treating patients; f. Dr. Haydarian shall have a notice posted in a visible area at all locations at which he is practising dentistry, as well on any websites through which appointment booking is available, advising patients that he will not treat any patients under 18 years of age and for all other patients that he must practise in the presence of a practice monitor. Such notice is to be approved in advance by the College and will be available in other language(s) as appropriate, based on the needs of his patients; g. Dr. Haydarian shall ensure that all patients are informed in advance of their appointment that he is required to practise in the presence of a practice monitor: i. For new appointment bookings, this information shall be provided at the time that the patient books their appointment; ii. For patient appointments already booked, the patient shall be advised in advance of their appointment and they shall be provided the option to cancel their appointment at no charge; h. The patient’s consent to be treated in the presence of a practice monitor must be obtained and noted in the patient’s chart. Without such consent, treatment cannot proceed; i. The College shall provide information to the practice monitor(s) as it deems necessary or desirable to enable or assist them in performing their role as practice monitor and in order to monitor Dr. Haydarian’s compliance with this order; j. Dr. Haydarian shall provide the College with proof of successful completion of an anger management course approved by the College within 3 months of the date of this Order; k. The following minimum criteria shall be met for a practice monitor to be approved by the College: i. They are a regulated health professional in Ontario, with a current certificate of registration from their regulator; ii. They have no history of conduct or practice issues as a regulated health professional; iii. They have no prior or current employment, associate, patient, or personal relationship with Dr. Haydarian; iv. They will enter into an undertaking/agreement with the College setting out their obligations as a practice monitor, including but not limited to that they have read the full terms of this interim order as posted on the College’s register and they are to provide monthly reports to the College, with the specific form and content to be prescribed by the College, and to report to the College immediately if there is any breach or suspected breach by Dr. Haydarian of the terms, conditions, or limitations on his certificate of registration or any suspected act of professional misconduct in terms of boundary issues and/or the sexual abuse of patients, and that they are to inform the Registrar immediately in writing if they are no longer able to act as a practice monitor; v. They remain available to the College for inquiries regarding Dr. Haydarian’s compliance with the conditions on his certificate of registration at all times; and vi. They satisfy the College that they have an understanding of the prevention of sexual abuse of patients and appropriate boundaries in dentist/patient relationships. This may involve, if deemed necessary by the College, attending an educational session with a College representative. l. Dr. Haydarian’s practice, and/or any location at which Dr. Haydarian practises dentistry, shall be monitored by the College by means of in-office review(s) and/or inquiries by a representative(s) of the College, at such time or times as the College may determine, without notice to Dr. Haydarian. For clarity, the monitoring referred to in this paragraph is to be completed by College staff or an agent of the College and it is distinct from the practice monitoring referred to in the subparagraphs above. m. Should Dr. Haydarian breach any of the terms, conditions or limitations set out at subparagraphs (b), (c), (d), (e) or (f) above, his certificate of registration shall be subject to immediate suspension by the College.
