As a result of a complaint, the Inquiries, Complaints and Reports Committee decided to caution Dr. Richard Lawrence Pass as follows:

• Dr. Pass must take his responsibility to protect health records seriously. As a custodian under the Personal Health Information Protection Act, 2004 (PHIPA), Dr. Pass has a legal duty to ensure that health records are not stolen, lost or disclosed without authority. Dr. Pass is responsible for safeguarding health records before, during and after a change in practice. Dr. Pass’ actions have raised the risk of privacy breaches, prevented patients from being able to access their health records and prevented health care providers from accessing information needed to provide health care. 
• As a member of a regulated profession, Dr. Pass is required to co-operate with the College. Dr. Pass has hindered the College’s investigation into clinical treatment issues by failing to produce the patient record. Dr. Pass’ conduct in deliberately and repeatedly failing to co-operate with the College’s investigation is a blatant show of disregard for his regulatory body.

As a result of its investigation of a complaint, the Inquiries, Complaints and Reports Committee decided to caution Dr. Richard Pass as follows:

• Dr. Pass must maintain an appropriate work space in which to treat patients to protect their health and well-being and in order to adhere to the College's Standard on Infection Prevention and Control in the Dental Office, which must be applied appropriately and consistently. Dentists also have an ethical duty to maintain a safe and healthy office environment for both patients and staff, and to follow all rules and regulations related to the operation of a dental practice, including workplace health and safety, and environmental protection.

• Dentists have a legal, professional and ethical obligation to provide or arrange for dental emergency treatment for their patients. In particular, Dr. Pass must provide patients with information on how to seek emergency treatment while he is away on vacation and/or for an extended period of time.
