-   Dr. Kershman is cautioned regarding the extent to which he encouraged his patient to sign a release of liability form in exchange for a refund, which the panel found to be excessive and unprofessional.
-   Dr. Kershman must at all times have the best interests of the patient at the
forefront and is cautioned not to direct the care a patient receives from another
professional.

As a result of a complaint, the Inquiries, Complaints and Reports Committee decided to caution Dr. John Kershman as follows:

• Your treatment and professional judgment in this matter did not meet the expected standards of the profession.
• You did not ensure that the patient was receiving regular dental care, nor that regular records were being obtained. As a result of your failure to take this action, the risk of root resorption was not being properly monitored.
• You did not ensure that the patient’s Invisalign treatment was being regularly monitored while she was overseas. You failed to provide comprehensive treatment options to the patient, and you failed to proactively follow up with the patient about her treatment.
• It is expected that you have learned from the orthodontic course and monitoring period that you completed in 2019, and that you have reflected upon this complaint and caution such that your orthodontic practice (including your professional judgment) will be remediated.
