As a result of a complaint, the Inquiries, Complaints and Reports Committee decided to caution Dr. James Fox as follows: • He must recognize the importance of being forthright with his patients in respect of errors he has made. The member should follow through with communicating those errors in a fulsome manner and document such discussions with patients in his patient records • In situations where he undertakes to correct an unfortunate error or has made an offer as a gesture of goodwill, the member should follow through on such commitments made to his patients • He must appreciate the importance of being forthright and truthful with his regulatory body, whether in response to a complaint filed against him or otherwise, and must ensure that his communications with his regulatory body reflect that understanding • The panel expects the member to incorporate the lessons learned from the ethics course that he completed as well as the one-on-one ethics counselling he has undertaken to take into his practice

As a result of a report, the Inquiries, Complaints and Reports Committee decided to caution Dr. James Fox as follows: • It was improper and a clear breach of the professional misconduct regulations that you delegated a controlled act, specifically venipunctures, to your dental assistant on 38 occasions. It was disappointing that five of those occasions occurred after you had been notified of the College’s investigation into this matter. • It is incumbent on you to understand your professional and legal responsibilities with respect to delegation, including whether or not dentists are permitted to delegate a procedure. • If you are unclear about the regulations that govern the dental profession and/or your professional and legal responsibilities as a dentist, it is your professional obligation to seek clarification from your regulator.
