Caution

As a result of its investigation of a report, the Inquiries, Complaints and Reports Committee decided to caution Dr. Smolen as follows:

-    Although Dr. Smolen knows or ought to know the proper protocols with respect to treating patients under sedation, such as obtaining or abiding by a facility permit, performing proper monitoring of patients under sedation, and keeping detailed sedation records, all of which are as set out in the College’s Standard of Practice on the Use of Sedation and General Anaesthesia in Dental Practice, he failed to do so;

-    In the interest of public safety, Dr. Smolen is cautioned to carefully and meticulously comply with the College’s Standard of Practice on the Use of Sedation and General Anaesthesia in Dental Practice, for any treatment he may perform under sedation in the future

-    Dr. Smolen should reflect on his clinical conduct in the area of sedation and on his previous interactions or lack thereof with the College in order to gain insight into his conduct which will hopefully lead to positive changes in the future.

Caution

As a result of its investigation of a formal complaint, the Inquiries, Complaints and Reports Committee decided to caution Dr. Edward Smolen as follows:

•	When performing a patient examination, Dr. Smolen must record all observations and treatment in the patient’s chart such intra- and extra-oral findings, condition of the soft tissues, the periodontal status of the teeth, dentition, mobilities, percussions, tooth sensitivity, occlusion, temporomandibular joint finings, oral cancer screening and the general dental condition. 

•	In order for consent to be informed, the dentist must provide the patient with certain information: the diagnosis or problem noted, nature and purpose of the proposed treatment along with the risks and benefits of such treatment, the treatment alternatives available along with the associated risks and benefits, the likely consequences of not having the treatment, and the cost of each treatment option. Dentists should keep a record of the nature of the conversation, the information provided, and the patient’s decision in the patient chart.
