As a result of a complaint, the Inquiries, Complaints and Reports Committee decided to caution Dr. Mark Hsiang-En Lin as follows: • When running seminars involving the use of live patients, Dr. Lin must recognize that he may create a dentist/patient relationship by treating patients even if he is not their primary dentist. The creation of this dentist/patient relationship comes with all of the usual obligations of such a relationship, including the duty to chart his involvement and to follow up in respect of the patient’s care. • Dr. Lin must be sure to make chart notes when he treats patients, even when this is done in the context of a seminar he is supervising. This obligation is that much more enhanced when adverse events occur during treatment. • Dr. Lin must be sure to make chart notes when he leads detailed discussions with patients about their follow-up care, even when this is done in the context of a seminar he is supervising. • Dr. Lin should ensure that he takes appropriate precautions to prevent or reduce the likelihood of implant screws being dropped into a patient’s throat. • When an item is dropped into a patient’s throat during treatment Dr. Lin is providing, Dr. Lin must recognize the urgency of the situation and ensure that appropriate medical care is sought immediately. • Dr. Lin must ensure that his submissions to the College are forthright and truthful. • When engaging in conversations with patients about future treatment plans and follow up care, Dr. Lin must ensure to be clear to the patient as to what future involvement he is agreeing to and must follow through on such undertakings. • When adverse events occur to patients that Dr. Lin has treated, even if this occurs in the context of a seminar he is supervising, he must ensure that the patient is left with clear direction and assistance for follow up care and is not being bounced between dentists. • Dr. Lin must carefully screen patient cases in determining eligibility for his seminars and not approve cases that are too complex to be dealt with in a learning or training environment.

As a result of a complaint, the Inquiries, Complaints and Reports Committee decided to caution Dr. Mark Hsiang-En Lin as follows: • You have a professional, legal, and ethical obligation to maintain your patient records in accordance with the standards of the profession. Good records are the hallmark of a professional and that any person reviewing the clinical records should have a full understanding of the treatment and discussions that occurred. Your patient record in this matter fell significantly short of the expected standards. This is highly disappointing to the College and reflects poorly on the dental profession in Ontario. It is expected that you learn from the course that you have been ordered to take, and this caution, such that your recordkeeping will be remediated. • You have a professional, legal, and ethical obligation to obtain the informed consent of your patients prior to rendering treatment. You failed to conduct a comprehensive informed consent discussion with the patient in this matter. This understandably led to a lot of confusion and mistrust from the patient. Your failure to meet this obligation is highly disappointing to the College and reflects poorly on the dental profession in Ontario. It is expected that you learn from the course that you have been ordered to take, and this caution, such that your informed consent protocols will be remediated.

If you do not understand a patient’s request, it is your obligation to ask appropriate questions so that you understand what a patient is seeking and can communicate transparently about whether you can provide it or whether the patient should be referred to another practitioner. • You have a professional obligation to create clear, contemporaneous progress notes when consulting with and treating patients. It is essential that you take to heart the lessons from your dental recordkeeping course and make appropriate changes to your recordkeeping practices.
