Caution

As a result of its investigation of a formal complaint, the Inquiries, Complaints and Reports Committee decided to caution Dr. Silver as follows:

•    Dentists are the face of the profession in their interactions with patients, but Dr. Silver demonstrated a consistent lack of professionalism in her communications with the complainant. Care and effort must be taken to demonstrate respect and consideration in professional interactions, even in stressful circumstances.
      -  When adverse incidents such as a percutaneous (through the skin) injury occur, Dr. Silver must provide information to the patient in a calm and forthright manner addressing the resulting risks to the patient and the recommended protocol for managing the event. She must also respect her patients’ autonomy to make decisions about and to provide or withhold informed consent for any resulting treatment options.
      -  Dentists’ professionalism must extend to all dentist-patient interactions, even those beyond the walls of the dental office. For example, when a dentist agrees to a monetary settlement with a patient, the dentist should follow through with that agreement without antagonizing the patient in her written or spoken tone or word choice.
      -  Dr. Silver must demonstrate respect for her patients, including in discussions about them with the College during its investigation of a complaint. It is not appropriate to refer to a patient in a derogatory manner.

•    Dr. Silver is expected to cooperate with the College, of which she is a regulated member, in its investigations.
      -  Cooperation with the College’s investigations is part of a dentist’s professional obligations, because patients are entitled to complain about alleged professional misconduct and the College has an obligation to investigate those complaints in the public interest. 
      -  It is unprofessional to call a routine aspect of the College’s investigation ridiculous and to indicate that you will only provide a requested transcript if the patient will pay for it. 
      -  Cooperation with the College includes allowing the Inquiries, Complaints and Reports Committee to make its own independent determinations, rather than making statements to the College that demean its investigative and decision-making processes.

•    Adverse events do occur occasionally in the practice of dentistry, and the way in which a dentist manages these events highlights the level of his or her professionalism. In most cases, if a dentist manages an adverse event calmly, respectfully and professionally, the dentist-patient relationship will remain intact and a resolution can be reached that is reasonable for both parties.
