As a result of a report, the Inquiries, Complaints and Reports Committee decided to caution Dr. Cohen as follows: • Dr. Cohen must be mindful to provide treatment that addresses his patients’ clinical needs in a cost-effective way. While Dr. Cohen may present both less and more expensive treatment options to his patients where both options could be appropriate in his professional opinion, he must explain the different advantages and disadvantages of each option to his patients in a forthright manner in order to enable the patient to make an informed decision. • If Dr. Cohen is unsure of what fee code to use for a particular treatment, especially when using new technology, he should make inquiries about the appropriate uses of fee codes before providing treatment and billing for it. • Where a fee code outlines a range of fees that may be charged, the clinical notes must justify the fees charged. For example, for emergency and specific examinations, the extent of the examination conducted and the time spent on it should correspond to the fees charged.
