As a result of its investigation of a formal complaint, the Inquiries, Complaints and Reports Committee decided to caution Dr. Dahan as follows: • In this case, the member charged fees in advance for follow-up exams and adjustments that may or may not have been required and ultimately were not performed. The member is cautioned that: - It is improper to charge fees in advance of treatment which may or may not be required. - It is improper to charge for three units of time for each appliance adjustment without knowing the extent of adjustment(s) required, if any. - It is unreasonable to keep money pre-paid for services that were not provided, rather than providing the patient with a refund. • The panel recognizes that dentists are free to set their own fees. However, in this case, the member’s treatment fees were well above the usual rate and were deemed by the panel to be excessive without any justification. The member is cautioned that if he sets fees that are above the usual norm, he must ensure that he can justify the increased rates and provide information to patients to give context to the relationship of his fees to the usual fees. • He is cautioned that his use of the title “doctor,” which is a protected title under the Medicine Act, was improper, misleading and/or inaccurate.

He must adhere to the College’s Practice Advisory on Professional Advertising and, in particular, he must not hold himself out on his website or elsewhere as a specialist in temporomandibular joint dysfunction. Notably, there is no such specialty. • Dr. Dahan is ultimately responsible for ensuring that the text on his website is accurate and that information about him and his practice is correct on the websites of other practices where he associates.
