As a result of a complaint, the Inquiries, Complaints and Reports Committee decided to caution Dr. Roger Avila Ricardo as follows: • The comments he made to the Complainant were sexual, unprofessional and inappropriate. These comments were a serious breach of patient and professional boundaries. It is incumbent upon him to establish and maintain appropriate boundaries with patients given the power imbalance between a dentist and patient. The Dentist is cautioned that he should reflect on the content of his communication to ensure that it is professional and appropriate in both delivery and content, as communication is both verbal and non-verbal (e.g. a wink). • As a dentist, he has a statutory obligation to cooperate with a College investigation and respond to inquiries from his regulator. The Committee cautions the Dentist about his lack of professionalism and cooperation with this investigation when required to provide records to the College. • He lacked professionalism by making disparaging, unprofessional comments about the Complainant, her background and her mental health, which was outside his scope of practice. Dentists are distinguished not only by their clinical skills but also by their professionalism. As a regulated health professional, it is incumbent upon him to maintain that professionalism in all patient interactions.
